That certainly is some wide speculation. Nomination Rogers Brown or Owen would be courting disaster... the Senate almost boiled over when they were nominated for the appellate courts. Either of their nominations would be apocalyptic.
If I were a betting man (which I am) I would put money on Gonzales or Olson.

Remember that the Repubicans have a majority in the Senate. I know they don't use it very often, but Bush should be free to nominate someone as conservative as Ginsberg is liberal-- she cruised through answering zero questions and getting 90 votes.

I know they have a majority. But they don't have 60 votes, and they won't get 60 votes on Rogers Brown or Owen. Also, the compromise over their appellate nominations was contingent on there being no further nominations of extreme candidates; renominating them would effectively void that treaty. Besides that, they're nowhere near as well qualified as Olson, Gonzales, Doug Ginsburg, and so on, so hopefully we won't have to deal with them.

Of course, Frist could change the Senate rules and 60 votes won't be necessary.
I just think it's funny how the press and most Democrats (and unfortunately, Republicans) expect Republicans to play fair with the Democrats and to respect their minority rights when they ran roughshod over the Republicans for 60 years when they had control.

Well, that's why I said it would be apocalyptic. For party relations, of course.

In that sense, yes, but the parties are so diametrically opposed right now, I feel like it woulnd't matter.
